Re:       Mandatory Posting of PERB Decision in Case No. SF-CE-1411-H

Dear Colleagues,

Pursuant to the California Public Employment Relations Board (PERB) Decision regarding Unfair Labor Practice Charge SF-CE-1411-H, it has been found that the University violated the Higher Education Employer-Employee Relations Act (HEERA), Government Code section 3560 et seq.

As a result, the University is required to post the attached "NOTICE TO EMPLOYEES" at all work locations where notices to UPTE-represented employees in the TX and HX bargaining units are customarily posted. The notice must be posted no later than Wednesday, April 23, and must remain posted until June 2, 2025 (30 consecutive workdays, excluding weekends and holidays) and must not be reduced in size, defaced, altered, or covered with any other material. The Notice has already been distributed to UPTE-represented employees via email.

In addition to the posting in each department, the notice will be posted on the Human Resources website under the "News" section with the heading "Notice to Employees of Public Employment Relations Board (PERB) Decision No. SF-CE-1411-H.

Lastly, the University is required to track and report the following information to PERB and UPTE:


  1.  The locations where the Order is posted (both physically and electronically).
  2.  The dates of the postings.
  3.  Business officers in departments employing UPTE-represented employees in the TX and HX bargaining units are required to input this information on UCOP's Smartsheet form at  Notice Posting Information Submission Form SF-CE-1411-H<https://app.smartsheet.com/b/form/0195f75d43b570e48d165cae4f619334>.
  4.  Please provide proof of the electronic postings, including a screenshot or printout of the website where the notice was posted and a copy of the email(s).
